Strengthening laws to protect whistleblowers, where is the process? SAFM, The Talking Point, 10 Mar 2025
Minister of Justice and Constitutional Development, Mamokoko Kubayi has added her voice in condemning the brutal killing of another whistleblower and community activist, Pamela Mabini. Her murder on Friday at her home in Gqeberha again sparked outrage bringing to light the continued problem of assassination of outspoken social justice activists. One of the things Minister Kubayi pointed to in a statement is reviewing legislation to close loopholes that hinder the safeguarding community activists, whistleblowers and witnesses to name a few. So we thought to use this opportunity to hear from Parliament, the Justice Department and the police regarding where the processes are and the impact these murders are having on the overall fight against crime, corruption and the mismanagement of the country.

Justice's Back-to-School Campaign, 2025

As part of the Back-to-School Campaign, a government initiative, The DOJ&CD hosted a Learner Dialogue, at the Leeukop Correctional Service in Gauteng on 25 February 2025. The Learner Dialogues aim to raise awareness of issues such as gangsterism, substance abuse, bullying, sexual assault, and teenage pregnancy. This platform seeks to empower learners to prioritise education, understand their rights and responsibilities, and advocate for a safe school environment. In addition, it aims to encourage all stakeholders, including parents, community leaders, and law enforcement to participate in promoting conducive teaching and learning environments in schools.


Minister Kubayi launches Human Rights Month at a Stakeholder Engagement Session with Civil Society, 28 Feb 2025

The Minister of Justice and Constitutional Development, Ms Mmamoloko Kubayi, officially launched Human Rights Month on Friday, 28 February 2025, by hosting a stakeholder engagement session with Civil Society Organisations. The session focused on issues related to family, civil, criminal, and constitutional law. The stakeholder engagement session will also serve as the official launch of Human Rights Month supported by the Department of Sport, Arts and Culture as the custodian of National Days.

Exploitation in child support, The Upside, Channel Africa, 9 May 2024
The issue of exploitation in child support is a complex matter that has many dimensions and far-reaching implications beyond financial matters. Parents may exploit the system to avoid fulfilling their responsibilities and children may become pawns in custody battles.

We follow a case where The High Court in Pretoria rejected a mother's claim for an increase in child maintenance from R28 500 to R35 629,42 per month, which also included a retroactive claim amounting to a total of R234,000. The High Court declined the mother's application, despite the existing R28 500 monthly support from her estranged husband.

Across South Africa, offices of the master of the high court are buckling, and attorneys who must deal with them daily are at their wits’ end. Lawyers are increasingly expressing dissatisfaction with the deepening dysfunctionality of the offices of the Master of the High Court. They highlight that the Master’s Office is causing significant delays, lasting months or even years, for crucial legal administrative procedures that should ideally be completed within weeks. The Master’s Office is responsible for overseeing numerous legal processes, including the winding up of estates of the deceased, handling bankruptcy and liquidation matters, and managing hundreds of millions of rands for the Guardian’s Fund. We find out more on the state of the Masters cause, and the offices plans to address this administrative nightmare.

Morio Sanyane speaks to Advocate Doctor Mashabane, Director-General of the Department of Justice and Constitutional Development. Last week, in Boksburg, Gauteng, a diverse group of stakeholders, including activists, legal experts, judges, ministers, and government officials, gathered for a three-day national conference. Their goal was to assess South Africa's criminal justice system and scrutinize the Criminal Procedure Act of 1977. This Act governs various aspects of criminal law, such as search and seizure, arrest procedures, charges, bail, pleas, evidence rules, verdicts, sentencing, and appeals. However, Justice Minister Ronald Lamola noted that the Act does not fully meet the evolving needs of society. Similarly, Advocate Shamila Batohi, head of the National Prosecuting Authority (NPA), expressed concerns about the system's dysfunctionality, stating it doesn't serve the public interest effectively. Deputy President Paul Mashatile also highlighted a decline in public confidence despite government interventions.

Justice minister Ronald Lamola announced on Tuesday during his budget vote speech in the National Assembly that his department is developing an online system for the reporting of deceased estates, which is expected to come on stream in the current financial year. Chief master in the Department of Justice and Constitutional Development, Martin Mafojane, says the plan is to make things easier for citizens and they should expect the system to work in July.
