The Minister of Justice and Constitutional Development, Mmamoloko Kubayi, has, in terms of section 13(3) of the National Prosecuting Authority Act, 1998 (Act No. 32 of 1998), appointed Advocate Samkelo Callaway Mtwana as Acting Director of Public Prosecutions (DPP) for the Eastern Cape Division.
The appointment takes effect from 1 May 2026 and will remain in place until the position of Director of Public Prosecutions for the Eastern Cape Division is permanently filled.
This appointment is necessitated by the impending retirement of the current Director of Public Prosecutions for the Eastern Cape Division, Mr Barry Madolo, who will retire at the end of April 2026 upon reaching the compulsory retirement age.
In line with section 13(3) of the National Prosecuting Authority Act, the Minister is empowered, after consultation with the National Director of Public Prosecutions, to appoint an Acting Director of Public Prosecutions from among suitably qualified candidates to ensure that the functions of the office continue uninterrupted whenever a vacancy arises or while a permanent appointment is pending.
Advocate Ntwana, who currently serves as Deputy Director of Public Prosecutions in the Eastern Cape Division, assumes the acting role to ensure continuity, stability, and effective leadership within the Division during this transitional period.
The process to appoint a permanent Director of Public Prosecutions is currently underway.
Minister Kubayi expressed her appreciation to Mr Madolo for his dedicated service and contribution to the National Prosecuting Authority and the justice system.
The Minister further wished Advocate Ntwana well in his new acting role and urged him to continue advancing the mandate of the National Prosecuting Authority.
